Refund Policy

We want you to love Cüe. Due to the digital nature of our product and instant license delivery, all sales are final. However, we offer refunds in specific circumstances outlined below.

Cüe is a digital product delivered instantly upon purchase. Once your license key is generated, it cannot be "returned." Please read all product information and verify your hardware compatibility before purchasing.

1. General Policy

All sales are final. Due to the immediate digital delivery of Cüe (license key and download access), we cannot offer refunds, returns, or exchanges after purchase, except as explicitly provided in this policy.

By completing your purchase, you acknowledge that:

  • Digital delivery is instant and irrevocable
  • You waive any statutory right of withdrawal that might otherwise apply (e.g., EU 14-day cooling-off period)
  • The license key is delivered immediately upon payment confirmation
  • Once delivered, the license key cannot be "returned" in any meaningful sense

2. Special Considerations

While all sales are generally final, we may consider discretionary resolutions in the following rare cases:

Technical Issues

If Cüe fails to function on supported hardware (MacBook, macOS 14+), please open an issue on our GitHub community repository. We will work with you to resolve the issue.

Duplicate Purchase

If you accidentally purchased the same tier multiple times, please let us know via GitHub issues.

  • Request period: Must request within 7 days of purchase

    • 3. Non-Refundable Situations

    All sales are final. Due to the digital nature of our software and instant license key delivery, we do not offer refunds for:

    • Change of mind: You simply changed your mind after purchase
    • Feature requests: Cüe lacks a feature you wanted (check feature list before purchasing)
    • Hardware incompatibility: You purchased without verifying hardware requirements
    • Accidental purchase: You accidentally purchased the product
    • Price tier confusion: You purchased a lower tier than intended (all tiers include identical software; difference is Wall of Legends presence)
    • Violation of terms: Your license was revoked due to Terms of Service violation

    4. Chargebacks & Disputes

    Contact us first! If you are dissatisfied with your purchase, please open an issue on our GitHub community repository before filing a chargeback with your bank or payment provider.

    Chargeback consequences: If you file a chargeback without first contacting us:

    • Your license will be immediately and permanently revoked
    • You will be charged for all costs associated with disputing the chargeback (including legal fees)
    • You may be banned from future purchases
    • We may pursue legal action for fraudulent chargebacks

    5. Benefit Revocation

    In the event that a refund is issued:

    • License key: Immediately revoked and deactivated
    • Download access: Removed from Polar customer portal
    • Wall of Legends: Your name removed from The Wall
    • Future updates: No longer entitled to updates or support

    Continued use prohibited: After a refund, you must cease all use of Cüe and delete all copies. Continued use constitutes software piracy and may result in legal action.

    6. Payment Fees

    Non-refundable fees: Payment processing fees (approximately 5.3% + $0.30 per transaction) are non-refundable. These fees are charged by credit card networks and payment processors regardless of refunds.

    Tax Invoices: As our Merchant of Record, Polar.sh automatically provides tax invoices to customers for all purchases. These invoices include GST/VAT/sales tax as applicable. If you need a copy of your tax invoice, contact support@polar.sh or download it from your Polar customer portal.

    7. EU Consumer Rights

    For EU/UK consumers: You may have a statutory 14-day right of withdrawal under EU consumer law.

    Waiver: However, by purchasing Cüe, you expressly acknowledge and agree that:

    • Digital delivery is immediate upon purchase
    • You consent to immediate performance
    • You waive your right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (digital content delivered with consent)

    This waiver is legally valid for digital products where the consumer has consented to immediate delivery and acknowledged loss of withdrawal rights.

    Exception: If the license key has not been delivered or used, EU consumers may have withdrawal rights. Contact us within 14 days if you have not received or used your license key.

    8. Policy Modifications

    We may update this Refund Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. The policy in effect at the time of purchase governs your refund rights.
