Refund Policy

Cüe is a digitally delivered software product developed by Muicci. Due to the inherent nature of digital goods -- which can be instantly accessed, downloaded, and used upon purchase -- all sales are final. We do not offer refunds, returns, exchanges, credits, partial refunds, store credits, or cancellations once a purchase has been completed and the software license has been issued. This policy applies without exception, regardless of circumstance.
THIS IS A LEGALLY BINDING NO-REFUND POLICY. BY COMPLETING YOUR PURCHASE, YOU EXPRESSLY WAIVE ANY AND ALL RIGHTS TO A REFUND, RETURN, EXCHANGE, CREDIT, OR REVERSAL OF PAYMENT. THIS WAIVER INCLUDES ANY COOLING-OFF PERIOD OR WITHDRAWAL RIGHT THAT MAY OTHERWISE BE AVAILABLE UNDER APPLICABLE CONSUMER PROTECTION LAWS, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
To be clear, no refund or credit will be issued for any reason, including but not limited to: (a) dissatisfaction with the Software or its features; (b) the Software not meeting your personal expectations or requirements; (c) inability to use the Software due to hardware incompatibility, software conflicts, or system requirements not being met; (d) failure to read the product description, feature list, system requirements, or these policies before purchasing; (e) change of mind or buyer's remorse; (f) accidental or duplicate purchase; (g) inability to install or activate the Software; (h) device changes, upgrades, or replacements; (i) future changes to macOS that may affect compatibility; (j) discontinuation or modification of any feature; (k) any other reason not listed here. You acknowledge that this no-refund policy is a material term of your purchase agreement.
The one-time purchase price (pay what you want, starting from $9.90 USD) grants you a per-device license to use Cüe. This is a non-recurring, one-time fee. There are no subscriptions, recurring charges, or hidden fees. The license is managed via the Polar.sh platform and is tied to a single device. Additional devices require additional license purchases. We do not offer trial versions, demo versions, free evaluation periods, money-back guarantees, or "try-before-you-buy" arrangements of any kind. It is your sole responsibility to thoroughly review all product information, feature descriptions, system requirements, demo videos, and documentation available at cue.app before making your purchase decision.
All payments are securely processed by Polar Software Inc., which serves as the Merchant of Record for all Cüe transactions. Polar Software Inc. handles payment processing, sales tax collection and remittance, and purchase receipts. By completing your purchase through Polar, you agree to both this Refund Policy and Polar's own terms of service. Billing inquiries should be directed to Polar Software Inc. in the first instance.
Before purchasing Cüe, you are strongly encouraged to: (a) review the complete feature list and product description on our website; (b) verify that your Mac has a notch (MacBook Pro or MacBook Air, 2021 or later models); (c) confirm your device meets the minimum macOS version requirements; (d) review any available demo videos, screenshots, or documentation; (e) read these Terms, our Terms and Conditions, and our Privacy Policy in full. By completing your purchase, you represent and warrant that you have performed adequate due diligence and are making an informed purchase decision.
By completing your purchase, you expressly acknowledge and agree to the non-refundable nature of this digital product. Filing a chargeback, payment dispute, or payment reversal with your bank, credit card company, PayPal, or any other payment provider after receiving access to the Software constitutes a breach of your purchase agreement and may constitute fraud. In the event of any chargeback or payment dispute, Muicci and/or Polar Software Inc. reserve the right to:
(a) Immediately and permanently revoke your License Key and all access to the Software without prior notice;
(b) Contest the chargeback with the payment processor, providing evidence of digital delivery and your agreement to these terms;
(c) Report the fraudulent activity to relevant fraud prevention databases and authorities;
(d) Pursue recovery of the purchase price, all chargeback fees, administrative costs, and reasonable legal fees;
(e) Pursue any and all additional legal remedies available under applicable law;
(f) Permanently blacklist your account, email address, and payment method from all future purchases of Cüe and any other products by Muicci;
(g) Share chargeback and fraud data with third-party fraud prevention services, payment processors, and other merchants to prevent future fraudulent activity.
You agree that initiating a fraudulent chargeback after receiving access to the Software constitutes theft of digital services and a breach of contract. You further agree to reimburse Muicci for any and all costs incurred as a result of any chargeback or payment dispute you initiate, including but not limited to chargeback fees (typically $15-$25 per dispute), administrative costs, investigation costs, and reasonable attorney's fees, regardless of the outcome of the dispute.
Muicci maintains comprehensive digital delivery records including timestamps of license key issuance, download link delivery, email confirmation, IP address at time of purchase, and your explicit agreement to this no-refund policy. These records will be submitted as evidence in any chargeback dispute. You consent to the use of these records in dispute proceedings.
Upon completion of your purchase, Cüe is delivered digitally through the following means: (a) a License Key is generated and delivered to your email address via Polar Software Inc.; (b) a download link for the Software is included in the same delivery email; (c) the Software becomes immediately available for download and installation. This constitutes complete and irrevocable delivery of the digital product. Once the License Key has been issued and the download link has been sent, the product is considered fully delivered regardless of whether you choose to download, install, or use the Software. The act of delivery, not the act of use, triggers the finality of the sale.
You expressly acknowledge that digital products cannot be "returned" in the traditional sense, and that once a License Key is issued, it is impossible for the Developer to reclaim or un-deliver the digital product. This fundamental characteristic of digital goods is the basis for this no-refund policy.
By completing your purchase, you represent and warrant that: (a) you are the authorized holder of the payment method used, or have explicit authorization from the cardholder to make this purchase; (b) you have sufficient funds or credit available to cover the purchase price; (c) all payment information you provide is accurate and complete; (d) you will not dispute or seek reversal of the payment after receiving the digital product. If you are not the authorized cardholder, you must obtain the cardholder's express permission before completing the purchase. Unauthorized use of a payment method is fraud and may be reported to law enforcement authorities.
If you believe your payment method was used without your authorization, contact us at support@cue.app within 48 hours of the transaction. We will work with Polar Software Inc. to investigate and resolve the issue directly, which is faster and more appropriate than filing a chargeback. Filing a chargeback without first contacting us constitutes a violation of these terms.
While we do not offer refunds under any circumstances, we are committed to helping you use Cüe successfully. If you experience genuine technical issues with the Software, please contact us at support@cue.app and we will make reasonable efforts to assist you. However, providing technical support does not create any obligation to issue a refund, nor does the existence of a technical issue entitle you to a refund. Technical support is provided on a best-effort basis and does not constitute a warranty of any kind.
By completing your purchase of Cüe, you explicitly acknowledge that: (a) you have read and understood this Refund Policy in its entirety; (b) you agree that all sales are final with no refunds, no exceptions; (c) you understand that Cüe is a digital product that cannot be "returned"; (d) you have reviewed the product features and system requirements before purchasing; (e) you waive any right to a refund, chargeback, or payment reversal; (f) you accept all terms set forth in this policy, our Terms and Conditions, and our Privacy Policy; (g) you are the authorized holder of the payment method used or have explicit authorization from the cardholder; and (h) you understand that filing a chargeback after receiving the digital product may constitute fraud and subject you to legal action and financial liability for all associated costs.
This Refund Policy is incorporated into and forms part of our Terms and Conditions. In the event of any conflict between this Refund Policy and the Terms and Conditions, the more restrictive provision (from the Developer's perspective) shall prevail. All disclaimers of warranties and limitations of liability set forth in the Terms and Conditions apply equally to this Refund Policy.
Any dispute arising from or relating to this Refund Policy, including disputes regarding chargebacks, shall be resolved through binding arbitration in accordance with the arbitration provisions set forth in our Terms and Conditions. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH ANY DISPUTE ARISING FROM THIS REFUND POLICY OR YOUR PURCHASE.
We reserve the right to update or modify this Refund Policy at any time. Any changes will be posted on this page with a revised "Last updated" date. Your purchase is governed by the Refund Policy in effect at the time of your transaction. Changes to this policy will not retroactively apply to prior purchases.
